These Terms of Use apply to the services offered by High Castle Metals LLC (“High Castle Metals”, “we” or “our”) in connection with the website and any related applications (collectively the “Site”). Any individual who visits, views, accesses or uses any version of the Site, including through a bot or other automated means, (“You” or “User”) is bound by these Terms of Use. By using the Site, You represent and warrant that You are at least eighteen (18) years of age and You hereby agree to be bound by all of the following provisions of these Terms of Use, which form a legally binding contract between You and High Castle Metals. If You do not agree to these Terms of Use, You are prohibited from accessing the Site and must immediately discontinue such access.

1. Content

You agree to treat all information obtained from the Site, including High Castle Metals materials and any information otherwise made available to You on the Site (individually and collectively, the “Content”) as proprietary to High Castle Metals. You agree that Content will be maintained as confidential and shall be protected as a trade secret of High Castle Metals. We do not ensure the accuracy of, endorse or recommend any Content, and You use such Content at Your own risk. You may view, access, or otherwise use the Content solely to obtain initial information from which further evaluation and investigation may commence.


 

You shall limit access to, viewing of, and use of active listings to personal and internal use, and shall not use any information obtained from the Site for further distribution, publication, public display, or preparation of derivative works except for the purpose of authorized promotion through social media. You shall not use any robot, spider, or other automated processes to monitor, data mine, or copy products; decompile, decode or reverse engineer software; or use the Site in an unlawful manner.


 

2. User Content

By agreeing to these Terms of Use, You represent and warrant that: (a) You are at least 18 years of age; (b) You have not previously been suspended or removed from the Site; and (c) Your use of the Site is in compliance with all applicable laws. You alone are responsible for maintaining the confidentiality of any passwords and for all actions taken via Your user profile.


 

Prohibited Conduct: You agree that You will not use the Site to:


 

  • Submit Content that is patently offensive, promoting racism, bigotry, or hatred.


     

  • Engage in activity harmful to minors or that harasses another person.


     

  • Transmit “junk mail,” “spam,” or fraudulent information.


     

  • Submit pornographic or sexually explicit material.


     

  • Use any automated device to monitor or copy web pages without consent.


     

  • Attempt to obtain the source code of the Site software.


     

3. Purchasing from High Castle Metals

3.1 Minimum Sales Orders There is no minimum sales order for shipments within the U.S. However, High Castle Metals reserves the right to request a ten percent (10%) deposit on sales orders deemed “significant” at our sole discretion.

3.2 Price Confirmations The price at which Your sales order is submitted is the locked-in price. The price is locked in for five (5) business days. To guarantee that price, payment must be dated within 24 hours of the confirmed sale and received by High Castle Metals within five (5) business days.

3.3 Cancellations Once a sales order confirmation number is issued, a binding contract is formed and the price is locked. If You fail to make payment, we may cancel Your order. All cancellations are subject to our Market Loss Policy.

4. Payment Options

Payment must be dated within 24 hours of Your sales order date.

4.1 Cash Discounts: Prices listed under “Check/Wire” reflect a 4.0% cash discount. 4.2 Checks: Shipment usually occurs 5–10 business days after deposit to ensure funds have cleared. 4.3 Credit Cards: We only ship to the verified credit card billing address.

5. Shipping and Insurance

Most orders ship within 5–10 business days. High Castle Metals insures all shipments for the full locked-in price.

  • Claims: We must be notified of a lost package within thirty (30) calendar days of shipment.

  • Exclusions: Insurance is void if You provide instructions to a carrier to leave parcels unattended or with a third party.

6. International Orders

High Castle Metals does not currently accept orders for international delivery.

7. Return and Exchange Policy

Exchanges for material defects must be requested within five (5) calendar days of receipt. You are responsible for return shipping costs and any risk of loss during the return process. Shipping and handling charges are non-refundable.

8. Selling to High Castle Metals

  • Minimum Transaction: Our minimum purchase order is $1,000 (USD).

  • Delivery: You must provide a tracking number by the end of the business day following confirmation.

  • Payment: Once quality is verified, payment is issued within 3–5 business days via Check or ACH (Free) or Bank Wire ($25 fee).

9. Market Loss Policy

If You default on a purchase or sales contract, You are liable for any Market Loss plus a $50.00 USD cancellation fee. Any market gains on cancellations remain the property of High Castle Metals. Future orders will be prohibited until all outstanding market loss balances are paid in full.

10. Risks and Liability

Precious metals markets are speculative and unregulated. Prices fluctuate throughout the day. High Castle Metals is not an insured financial institution and does not provide investment advice.

Limitation of Liability: In no event shall High Castle Metals' aggregate liability exceed the total amount of fees actually paid by You to High Castle Metals for the transaction in question.

11. Choice of Law

These Terms are governed by the laws of the State of Texas. You agree to the exclusive jurisdiction of the courts sitting in Collin County, Texas.

12. Mobile Terms of Service

By consenting to High Castle Metals’ mobile message service, You agree to receive recurring SMS/text messages. Message and data rates may apply. You can opt-out at any time by texting "STOP" to our shortcode.
